In a series of recent articles, Matthew Clayton, Andrew Williams and Rasmus Sommer Hansen and Soren Flinch Midtgaard argue that a key virtue of Ronald Dworkin’s account of distributive justice, Equality of Resources, is that it provides a distribution that is continuous with the evaluations of the individuals whom it ranges over. The idea of continuity, or as Williams calls it the ‘continuity test’, limits distributive claims in at least one important way: one person cannot claim compensation from another (...) when she does not believe she is worse off than him. In this article, I challenge whether an account of distributive justice should be continuous with the evaluations of the individuals whom it ranges over. My argument is that continuity competes with another consideration, namely, correctness. An account of distributive justice should track who actually is disadvantaged, not whether individuals believe they are disadvantaged. In addition, I offer an account of how we can get closer to a correct account of who is disadvantaged based on two sources of evidence. (shrink)

This is an opinionated guide to the literature on epistemic dilemmas. It discusses seven kinds of situations where epistemic dilemmas appear to arise; dilemmic, dilemmish, and non-dilemmic takes on them; and objections to dilemmic views along with dilemmist’s replies to them.

This paper explores the effects of performativity on the culture of a Scottish secondary school, Lochview High School. This is set against a backdrop of the Scottish education policy context which in recent years has been heavily focused on reducing the poverty-related attainment gap, namely through the Scottish Attainment Challenge (SAC). The analysis of the empirical data is supported by a cultural and ecological framework which emphasises the interwoven and complex nature of the school system. In particular, the paper provides (...) a critique of accountability and performative agendas which often run counter to other national agendas, such as the SAC. Through observations, staff interviews (teachers and senior management), and student interviews, task-based activities and group discussions, the data suggests performative and accountability measures are inextricably woven through the education system within which Lochview is situated. Despite this, Lochview provides a case study of a school which successfully navigates competing agendas. However, it is not without its struggles, but the school community often finds rewards and benefits in the positive school culture which develops as a result of responding to the local community’s needs. Moshe Tati, a sanitation worker in Jerusalem, was among the first of more than a thousand mortally sick Israelis who signed up for illicit and clandestine ‘transplant tour’ packages that included: travel to an undisclosed foreign and exotic setting; five-star hotel accommodation; surgery in a private hospital unit; a ‘fresh’ kidney purchased from a perfect stranger trafficked from a third country. Although Tati’s holiday turned into a nightmare and he had to be emergency air-lifted from a rented transplant unit in (...) a private hospital in Adana, Turkey back to Israel, Moshe became a poster-boy of transplant tourism for the next decade. João Cavalcanti was among the first of 38 residents of the slums of Recife recruited by retired military Captain Ivan da Silva and his sidekick Captain Gadddy Tauber to travel to Durban, South Africa to provide a spare kidney to an Israeli transplant tourist in Durban. This article examines the logics and practices through which kidney buyers and kidney sellers, organs brokers, surgeons and their accessories convince themselves that they are engaged in an illegal but still mutually beneficial ‘medical-recreational’ adventure, an ‘extreme medical sport’ of sorts. While life, health and survival motivate ‘transplant tourism’, a euphemism for human trafficking in spare body parts, the freedom to roam, mobility, is an essential feature of transplant tours for kidney buyers and kidney sellers. As a contribution to the continuing debate about tax practitioner ethics, this paper explores the main streams of Western ethical thought that are relevant to tax practitioners’ work, most typically deontology and consequentialism. It then goes on to consider the impact of such ethical influences on the professional ethical codes of conduct that govern tax practitioners’ work, and attempts to unravel the complex work and ethical environment of the practice of tax in terms of tax compliance and tax avoidance. The (...) paper then examines the prior studies on tax practitioners and ethics and the type of dilemmas that practitioners face in the context of their work. The paper proceeds to examine empirically the extent to which tax practitioners take a consequentialist versus a deontological approach in their reasoning about moral dilemmas. This article draws on a five-year, multi-sited transnational research project on the global traffic in human organs, tissues, and body parts from the living as well as from the dead as a misrecognized form of human sacrifice. Capitalist expansion and the spread of advanced medical and surgical techniques and developments in biotechnology have incited new tastes and traffic in the skin, bones, blood, organs, tissues, marrow and reproductive and genetic marginalized other. Examples drawn from recent ethnographic research in Israel, the (...) Palestinian Authority and Turkey serve to cast light on the dark side of organs harvesting and transplantation. The article focuses on the dangers of the `fetishized kidney' for both sellers and buyers, for whom this new commodity has become an organ of opportunity and an organ of last resort. The bodily sacrifice is disguised as a donation, rendered invisible by its anonymity, and hidden under the medical rhetoric of `life saving' and `gift giving'. It suggests that the ultimate fetish as recognized long ago by Ivan Illich is the idea of `life' as object of manipulation. (shrink)

What makes for a good life, or a beautiful one, or, perhaps most important, a meaningful one? Throughout history most of us have looked to our faith, our relationships, or our deeds for the answer. But in A Significant Life, philosopher Todd May offers an exhilarating new way of thinking about these questions, one deeply attuned to life as it actually is: a work in progress, a journey—and often a narrative. I develop a broadly reliabilist theory of non-ideal epistemic rationality and argue that if it is correct we should reject the recently popular idea that the standards of non-ideal epistemic rationality are mere social conventions.

Philosophers often claim that humility is a dependent virtue: a virtue that depends on another virtue for its value. I consider three views about this relation: Specific Dependence, Unspecific Dependence, and Fittingness. I argue that, since humility cannot uniquely depend on another virtue, and since this uniqueness is desirable, we should reject Specific and Unspecific Dependence. I defend a Fittingness view, according to which the humble person possesses some objectively good quality fitting for humility. I show beyond Slote’s original characterization (...) of the dependence relation that, even if humility’s value depends on having objectively good qualities, humility itself can be one such quality. So, humility can depend on itself. I call this view Bootstrapped Fittingness. (shrink)

Michel Foucault introduced a new form of political thinking and discourse. Rather than seeking to understand the grand unities of state, economy, or exploitation, he tried to discover the micropolitical workings of everyday life that have often founded the greater unities. He was particularly concerned with how we understand ourselves psychologically, and thus with how psychological knowledge developed and came to be accepted as true. In the course of his writings, he developed a genealogy of psychology, an account of psychology (...) as a historically developed practice of power. The problem such an account raises for much of traditional philosophy is that Foucault's critique of psychological concepts is ultimately a critique of the idea of the mind as a politically neutral ontological concept. As such, it renders politically suspect all forms of subjective foundationalism, and the epistemological justification for Foucault's own writings is then called into question. Drawing on the writings of such Anglo-American philosophers as Wilfrid Sellars and Ludwig Wittgenstein, Todd May refutes the idea that Foucault's critiques of knowledge, and especially psychological knowledge, undermine themselves. The great political ideas and movements of the modern world were founded on a promise of universal emancipation. But in recent decades, much of the Left has grown suspicious of such aspirations. Critics see the invocation of universality as a form of domination or a way of speaking for others, and have come to favor a politics of particularism—often derided as “identity politics.” Others, both centrists and conservatives, associate universalism with twentieth-century totalitarianism and hold that it is bound to lead (...) to catastrophe. This book develops a new conception of universality that helps us rethink political thought and action. Todd McGowan argues that universals such as equality and freedom are not imposed on us. They emerge from our shared experience of their absence and our struggle to attain them. McGowan reconsiders the history of Nazism and Stalinism and reclaims the universalism of movements fighting racism, sexism, and homophobia. He demonstrates that the divide between Right and Left comes down to particularity versus universality. Despite the accusation of identity politics directed against leftists, every emancipatory political project is fundamentally a universal one—and the real proponents of identity politics are the right wing. But under the surface, as I think the papers in this special issue demonstrate, the civilized heat comes from a good deal of passion. One way in which philosophy can contribute to the debate is by making plain the sources of this (...) passion, so that the motivating forces are clearer.One motivating force is this: There will be people who do not have dementia but who have symptoms or signs that might predict dementia, which cause them concern, whom we might help by early intervention. The intervention might involve advice and support, or it might involve some form of drug treatment; and in the utopia of our dreams, it might involve prevention. All of this is very motivating for clinical scientists. It also offers a laudable motivation to pharmaceutical companies, who simultaneously must have regard to the possibility of profits for their shareholders.Here, however, is an alternative motivation: The effects of aging must not be ignored if help can be given, but older people must not be stigmatized by a medical process that thrusts disabling labels on them. People age, but they age differently, and it is better to recognize difference, both from a biological and from a philosophical perspective. Thus, a passionate commitment to the cause of individual agency in old age and a desire for authentic autonomy for older people provide strong motivation too.At root, then, the conflicting passions over MCI reflect the age-old struggle in the philosophy of psychiatry between the natural sciences (Naturwissenschaften) and the human or cultural sciences (Geisteswissenschaften): the tension is between a tendency to approach the problem with the aim of eliciting a scientific explanation and a tendency to try to achieve a human and cultural understanding of the phenomena (Phillips 2004). So, although MCI can be regarded as an explanatory diagnostic entity with some predictive value, it can also be regarded as a label that might cause harm or as a human phenomenon that requires understanding. Furthermore, MCI raises ontological questions about the nature of disease entities. And there is a wider issue as well about how aging itself should be regarded.From a biological perspective, it turns out there is no clear cutoff between what is normal and what [End Page 1] is not. Hence, in a number of ways, values seem to be as important as facts (Sadler 2005). Perhaps philosophy should content itself with saying no more than this: MCI ought not to be considered or debated as if it lies outside the realm of evaluative judgment. The very possibility of its existence as a clinical entity is a matter worthy of moral and social discourse.The direction of thought indicated here and in the papers that follow, however, is more radical than the easily won point that the "diagnosis" of MCI is not value free. On the back of the biological point, that there is a continuum between physiological and pathological aging, is the broader philosophical point that aging can neither be understood solely in terms of physiology nor in terms of pathology, nor even in terms of both. Ageing represents, inter alia, a social and cultural phenomenon manifest in the context of particular psychological and spiritual responses to a mixture of physiological adaptations and pathological predispositions. Without the broader picture, we tend to characterize old age, as Michael Bavidge has suggested elsewhere, in terms of deteriorations: "We should think of old age as offering alternative rather than impaired ways of experiencing life" (2006, 49). The difficulty is that any diagnosis seems to suggest impairment in one form or another. Background Paramedicine is a newly regulated profession in Australia and with the introduction of regulation in 2018 for this profession came increased responsibilities – including the introduction of a professional code of conduct. Several countries now have regulation of paramedicine and associated professional codes to guide ethical and professional behaviour. Despite this, there has been no published research into paramedic understanding and use of their professional codes. Objectives To explore Australian paramedics’ use and understanding of their professional code of conduct. (...) Research design: This study used a qualitative descriptive design, underpinned by hermeneutic theory. Reflexive thematic analysis was used to analyse the interview data and identify Australian paramedic perceptions surrounding the use of their code of conduct. Results 11 Registered Paramedics from several states and territories were interviewed. Participants were invited to interview by advertisement on social media and the Australasian College of Paramedicine Web site. Participants had varied professional backgrounds including clinical work, education providers and policymakers/managers. Four themes were identified as follows: Theme 1 – ‘You don’t know, what you can’t know’; Theme 2 – ‘I don’t need the code – the code is for others’; Theme 3 – ‘It’s about time’; Theme 4 – ‘Navigating the new profession’. Ethical considerations: Ethics approval was granted by the Monash University Human Research Ethics Committee (MUHREC) Project ID: 28921. All participants provided informed consent. Conclusions The results of this study suggest that paramedics’ knowledge and use of their code is limited, and participants appeared to mostly rely instead on ‘common sense’ morals. Participants did appear to want to understand the broad concepts of the code more and have this better integrated into the profession. The code was also interpreted as important to the paramedic profession and its new professional status, helping to legitimise it as a health profession in Australia. (shrink)

Notwithstanding an ongoing concern about the low representation of certain groups in higher education, there is reluctance on the part of politicians and policy makers to adopt positive discrimination as an appropriate means of widening participation. This article offers an account of the different objections to positive discrimination and, thereafter, clarifies and criticises the view that universities ought to select those applicants who are expected to be most successful as students. It distinguishes arguments from meritocracy, desert, respect, and productivity and (...) shows how these arguments are compatible with the use of positive discrimination in higher education. Michael Raposa's long career as a preeminent interpreter of Peirce's writings on religion has taken a surprising turn and he has done what Peirce, in his most famous essays from 1877–78, suggested could not be done. Though Peirce early on cautioned against construing thought as having any legitimate function beyond the fixation of belief and the production of "thought at rest," and warned explicitly against thinking as a form of amusement,1 throughout Theosemiotic Raposa highlights an additional dimension of thought as (...) We see nonviolent resistance all over today’s world, from Egypt’s Tahrir Square to New York Occupy. Although we think of the last century as one marked by wars and violent conflict, in fact it was just as much a century of nonviolence as the achievements of Mohandas Gandhi and Martin Luther King, Jr. and peaceful protests like the one that removed Ferdinand Marcos from the Philippines clearly demonstrate. But what is nonviolence? What makes a campaign a nonviolent one, and how (...) does it work? What values does it incorporate? In an attempt to examine the notion of unstable difference in Herodotus as part of the presentation of an unstable world, this article focuses on the stories involving Atossa, Darius’ wife. In the stories of Atossa, obvious markers of difference appear, only to come into question, especially in Herodotus’ stories. Never in these stories, though, does Herodotus completely subvert the audience’s expectations of sexual or cultural difference—the differences between men and women become unstable in the stories,yet those differences do persist. (...) In presenting stories like those of Atossa, Herodotus confronts his reader with a complex and unstable world. By refusing to add artificial stability to his narrative, Herodotus allows his reader the experience of that world in all of its complexity. (shrink)

Wallace became a full-time naturalist in 1848, the year when he and Bates set out on their journey to South America. Wallace was twenty-five at the time and over half of his life had been spent in various parts of Wales, the land of his birth. Commentators have tended to gloss over or ignore any formative influences from this early period of his life or even to dismiss them as non-existent. This is surprising as it was during the eight or (...) so years in Wales leading up to 1848 that Wallace's interest in natural history emerged. ‘The importance of this early period in Wallace's life can scarcely be over-emphasized’ wrote Durant in his account of the development of the Wallace personality, but he omitted any specific reference to the significance of the early period in Wales. Those seeking a simple unitary cause for Wallace's conversion to natural history usually locate this in his visit to Leicester in 1844 and his meeting there with H. W. Bates. ‘The odyssey began … in 1844, in Leicester’ wrote Brooks, adding that ‘the more remote parts of … southern Wales had offered little reading material…’ This, and similar claims, are presumably founded primarily on Wallace's belief—expressed sixty years later—that it was at Leicester that he first familiarized himself with Malthus'Essay on the Principles of Populationand Humboldt'sPersonal Narrative of Travels in South America.There is, however, evidence that Wallace was probably familiar with at least one of these books some time before his visit to Leicester and that it was during his period in southern Wales that his interest in natural history emerged and developed.
